NO PURCHASE REQUIRED TO ENTER OR WIN: Please read these Official Sweepstakes Rules (“Official Rules”) of Virginia811 (“Sweepstakes Sponsor”) ACE Your Outdoor Space (the “Sweepstakes”).
ELIGIBILITY TO ENTER: This promotion is open to persons who satisfy the following requirements: you must be a legal resident of Virginia and you must be at least eighteen (18) years of age. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. Odds of winning will depend on the number of eligible entries received.
Sweepstakes entries must meet eligibility requirements, or the entry will not be counted. Incomplete entries will be disqualified. Only one prize per eligible entry is allowed. Duplicate entries will not be accepted.
SPONSOR: The Sweepstakes is sponsored by Virginia 811, with headquarters located at 1830 Blue Hills Cir NE, Roanoke, VA 24012.
AGREEMENT TO OFFICIAL RULES: By entering the Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sweepstakes Sponsor, which are final and binding in all matters related to the Sweepstakes.
ENTRY DEADLINE: The Sweepstakes runs from 12:01 a.m. Eastern Time on April 1, 2023 through 11:59 p.m. Eastern Time on April 30, 2023 (“Sweepstakes Period”).
HOW TO ENTER: There are two ways to enter the Sweepstakes: (i) registering online at https://va811.com/april-sweepstakes/; (ii) submitting a valid entry via mail as described below. There is a limit of one (1) entry per entrant regardless of entry method. In the event more than one entry is received with respect to any participant, the first valid entry processed by the Sweepstakes Sponsor will be considered the only valid entry.
Online Registration: To enter via the Virginia811 Sweepstakes landing page, go to http://va811.com/April-Sweepstakes/ and complete online entry form.
Mail-In Method. Print your first and last name, complete street/mailing address (including zip code), your email address, phone number (including area code), give your age from one of the following age groups (18-24 years old; 25-34 years old; 35-44 years old; 45-54 years old; 55-64 years old; 65-74 years old; 75 years or older), answer that you are either a renter or homeowner, answer how did you hear about the Sweepstakes (either in store counter card display at an Ace Hardware story, online, on social media, or other), write out and initial the following statement: I acknowledge that I have read and accepted the terms and conditions of the Sweepstakes, and mail letter with sufficient first-class postage affixed, to Ace Your Outdoor Space Sweepstakes, 1830 Blue Hills Cir NE, Roanoke, VA 24012. Such mail-in entries for the Sweepstakes must be legible, and submitted in original hand-printed form. A mail-in entry pursuant to this paragraph will be deemed valid and eligible for consideration only if such entry is received at the address above prior to the end of the Sweepstakes Period. All entry forms must be filled out completely and truthfully. Failure to complete the entry and provide truthful and pertinent information may result in disqualification from the Sweepstakes. Disqualification is in the sole discretion of Sweepstakes Sponsor.
Entries become the property of Sweepstakes Sponsor and will not be returned. Sweepstakes Sponsor may use any of the entries for any purpose whatsoever, without further compensation to the entrant. Sweepstakes Sponsor is not responsible for lost, incomplete, damaged, illegible, late, or misdirected entries, or for errors in mechanical transmission, technical or wireless difficulties or inability to transmit Internet data.
DRAWINGS: Prizes. Four (4) entries will be drawn randomly from the pool of all entries received as of April 30, 2023: the entries will be drawn the first business day after the end of the entry period. If the first entry drawn does not meet the Sweepstakes requirements, determined by Sweepstakes Sponsor in its sole discretion, entries will continue to be randomly drawn until an entry meeting the Sweepstakes requirements is selected and the prize is awarded. Odds of winning depend on the number of eligible entries received.
NOTIFICATION: The potential winner(s) will be notified within 5 business days of award, subject to eligibility verification. By entering the Sweepstakes, the entrant hereby grants permission to be contacted via telephone and email. If a potential winner does not come forward or cannot be found within 30 days of e-mail notification or notification via phone or is otherwise found to be ineligible, he/she will forfeit his/her prize and the prize may be awarded to an alternate winner from among all remaining eligible entries. Entrants agree that Sweepstakes Sponsor has the sole right to determine the potential winner of the Sweepstakes and all matters or disputes arising from the Sweepstakes and that its determination is final and binding.
PRIZES: The winner will receive a $500 gift card, or combination of gifts cards to equal $500, to Ace Hardware®. A prize will be forfeited if the winner fails to claim the prize by the deadline, fails to execute the prepared forms of release and waiver (if required by Sweepstakes Sponsor, in its sole discretion), or if the selected winner is not eligible in accordance with these Official Rules. Prizes are not assignable or transferable. Federal, state and local taxes are solely the responsibility of the winner. If required by law, prize winners will receive a 1099 tax form reflecting the actual value of the prize. Winners agree to claim their prize as directed by Sweepstakes Sponsor. Prize redemption or collection may be made by turning in a release form and W9, prize mailed to winner, or other processes. In the event that a prize is mailed to the winner, pursuant to winner’s prior written consent, the winner assumes the risk of the prize’s safe arrival. Winners may be required to: (a) furnish photographic identification in the form of a government issued document; and (b) furnish a signed affidavit or such other documentation: (i) acknowledging acceptance and compliance with these Official Rules; (ii) confirming eligibility to participate in the Sweepstakes; and (iii) providing the Sweepstakes Sponsor any other reasonably requested information, including, without limitation, a social security number and any other information required for tax reporting purposes, in a form determined by the Sweepstakes Sponsor. Failure to furnish such information and signed affidavit within the time period stated in the Sweepstakes Sponsor’s request may cause disqualification, as determined in Sweepstakes Sponsor’s sole discretion.
Sweepstakes Sponsor is not responsible or liable for any incorrect or inaccurate entry information or other errors in the printing, offering, or administration of the Sweepstakes or in the announcement of the prize(s).
Any expenses incurred by the entrant during the entry process, including, but not limited to, postage, mileage, internet access fees, etc., are the sole responsibility of each entrant and Sweepstakes Sponsor will not issue reimbursement for any expenses whatsoever.
Total approximate retail value of the Prize: $500.00. No substitution, exchange or transfer of prize by any winner is permitted. Limit: 1 prize per person.
ELIGIBILITY RESTRICTIONS:
A. This Sweepstakes is void where prohibited or restricted by law and is subject to all federal, state, and local laws and regulations.
B. Employees of Virginia811 and Ace Hardware, and their immediate families (i.e., parents, spouse, siblings, children, grandparents, step parents, step children and step siblings and their respective spouses, and those living in the same household, whether or not related) are not eligible to enter this Sweepstakes.
C. Entrants must be a US Citizen and a Virginia resident and be 18 years or older at the time of entry.
D. By entering the Sweepstakes, each entrant agrees to be bound by and comply with these Official Rules.
CONDITIONS OF ENTRY:
A. Use of winners’ names. By entering, each entrant grants permission, without further compensation or approval, to the Sweepstakes Sponsor, its affiliates, agents and licensees, to use the entrant’s name, voice, photograph, likeness and biographical material for promotional purposes in connection with the Sweepstakes.
B. Execution of Affidavit and Release. By entering, each entrant agrees that if selected as a prize winner, he/she will sign a release and waiver of liability, if required by Sweepstakes Sponsor, in its sole discretion. The prize will be forfeited and awarded to another entrant if the selected winner does not execute the prepared form of release and waiver within 10 days of the request to sign such release and waiver, or if the selected winner is not eligible in accordance with these Official Rules.
C. Release of Liability. By entering, entrants agree to release Sweepstakes Sponsor, its employees, officers, directors, parent companies, subsidiaries, affiliates and partners from any claim, loss, liability, damage or injury of any kind arising from their entry in the Sweepstakes, or their receipt or use of the Sweepstakes prize(s), and any Sweepstakes-related activity.
D. Prize Substitutions. No substitute prizes are available; however, Sweepstakes Sponsor may, at its discretion, substitute prizes of equal or greater value. Prizes are non-transferable and may not be redeemed for cash. If the prize becomes unavailable for any reason, Sweepstakes Sponsor reserves the right to substitute a prize of comparable value.
LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES SHALL SWEEPSTAKES SPONSOR OR ITS SUBSIDIARIES OR AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, ATTORNEYS’ FEES, OR ANY OTHER DAMAGES.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY CIRCUMVENT, DISRUPT, OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTAKES, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY ANY SUCH INDIVIDUAL FROM PARTICIPATION IN THE SWEEPSTAKES OR ANY OTHER SWEEPSTAKES.
FORCE MAJEURE: If for any reason, this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Sweepstakes, Sweepstakes Sponsor reserves the right, in its sole discretion, to terminate or suspend the Sweepstakes or any portion of the Sweepstakes for any reason.
OWNERSHIP OF INFORMATION: Information submitted in Internet and mailed entries, including entrant’s name, address, e-mail address, etc., shall become the property of Sweepstakes Sponsor, but will not be transferred, sold, or otherwise used by Sweepstakes Sponsor for any purpose other than the administration of this Sweepstakes.
CHOICE OF LAW AND VENUE: All entrants agree, by entering the Sweepstakes, to submit to the personal jurisdiction of the courts of Virginia. Virginia law shall govern this Sweepstakes, without regard Virginia’s choice of law rules. The courts of Virginia shall be the exclusive forum for any dispute regarding any of these Official Rules or any activity associated with the Sweepstakes.
Sweepstakes Sponsor reserves the right in its sole discretion to supplement or make changes to these Official Rules at any time without notice. Sweepstakes Sponsor reserves the right in its sole discretion to interpret these Official Rules of this Sweepstakes, and such interpretation shall be binding upon all entrants. Sweepstakes Sponsor shall not be responsible for any administrative errors involved in the execution of this Sweepstakes.
